1. Introduction
These Terms of Service ("Terms") govern your access to and use of the website at trystilla.us and all related content, features, tools, products, and services (together, the "Services"), and your purchase of products from us. The Services are operated by Berecz Helga (Egyéni Vállalkozó / sole trader), 1033 Budapest, Huszti út 2. 2/5, Hungary ("Stilla," "we," "us," "our") and are powered by Shopify.
By accessing or using the Services, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and by our Refund & Returns Policy, Shipping Policy, and Privacy Policy, each incorporated by reference. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract. By using the Services you represent that you meet these requirements and that the information you provide is accurate and complete.
3. Health & Wellness Disclaimer — Please Read Carefully
The Stilla™ Pen is a consumer wellness device. It is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition. Statements made on the Services have not been evaluated by any medical or governmental regulatory authority.
- The Stilla™ Pen is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or another qualified health provider with any questions about a medical condition, and never disregard or delay professional advice because of something you read on the Services.
- Do NOT use the Stilla™ Pen if you have a pacemaker or any implanted electrical or electronic device. If you have any medical condition, are pregnant, or are unsure whether the product is suitable for you, consult your doctor before use.
- Use the product only as directed in the accompanying instructions.
- Individual results vary. Any testimonials, reviews, or examples on the Services reflect individual experiences and are not a guarantee that you will achieve the same or similar results. Content on the Services is provided for general informational and wellness purposes only.
You use the product at your own risk and agree to follow all instructions and warnings provided.
4. Products, Descriptions & Availability
We aim to describe and display our products accurately, but we do not warrant that descriptions, images, colours, or other content are complete, current, or error-free, and actual products may vary slightly. We may change, limit the quantities of, or discontinue any product at any time, and may refuse or cancel orders in accordance with these Terms.
5. Pricing & Payment
- Prices are displayed and charged in the currency shown at checkout (which may be your local currency) and may change at any time before you place an order.
- You are responsible for any applicable taxes and for any customs duties or import charges levied by your country (see our Shipping Policy).
- By submitting payment information, you represent that you are authorised to use the payment method and authorise us and our payment processors to charge the total amount of your order. We use third-party payment processors and do not store your full card details.
- In the event of a pricing or product error, we may cancel the affected order and refund any amount paid, even after an order confirmation has been sent.
6. Orders & Order Acceptance
Your order is an offer to purchase. An order confirmation acknowledges receipt and does not constitute acceptance. We reserve the right to accept or decline any order, in whole or in part, and to cancel an accepted order (for example, due to suspected fraud, payment issues, stock or fulfilment problems, or errors), in which case your sole remedy is a refund of amounts paid for the cancelled items.
7. Shipping & Delivery
Shipping and delivery are governed by our Shipping Policy. Delivery timeframes are estimates only and are not guaranteed. You are responsible for providing complete and accurate delivery details, including a valid phone number. Risk of loss passes to you when the products are delivered to you or your nominated address, except as required otherwise by mandatory law.
8. Returns, Refunds & Guarantee
Returns and refunds, including our 60-Day Money-Back Guarantee, are governed by our Refund & Returns Policy.
9. Promotions, Discounts & Free Gifts
Any promotions, discount codes, bundle offers, or free gifts are offered at our discretion, may carry additional terms, may be limited to one per customer or household, and may be modified or withdrawn at any time before you order. Free gifts have no cash value, and their treatment on returns is set out in the Refund & Returns Policy.
10. Acceptable Use
You agree not to: use the Services for any unlawful or fraudulent purpose; provide false information; interfere with, disrupt, or attempt to gain unauthorised access to the Services; copy, scrape, or harvest data; introduce malware; or infringe our or others' rights. We may suspend or terminate access for any breach.
11. Intellectual Property
All content on the Services — including the Stilla™ name and logo, text, graphics, images, and software — is owned by or licensed to us and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.
12. Reviews & Submissions
If you submit reviews, comments, or other content, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, and display that content in connection with the Services. You are responsible for your submissions and confirm they are accurate and do not infringe any third-party rights. We may remove content at our discretion.
13. Third-Party Links & Services
The Services may contain links to third-party sites or services we do not control. We are not responsible for their content, policies, or practices, and your dealings with third parties are solely between you and them.
14. Disclaimer of Warranties
Except as expressly stated in these Terms or required by mandatory law, the Services and products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain exclusions; in those places the above may not apply to you, and you may have consumer guarantees that cannot be excluded (see Section 17).
15. Limitation of Liability
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Services, any product, or any order is limited to the amount you paid for the order giving rise to the claim. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, or data. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer law.
16. Indemnification
You agree to indemnify and hold harmless Berecz Helga (Egyéni Vállalkozó) and our affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services or products, or your violation of any law or third-party right.
17. Your Consumer Rights (United Kingdom, Australia, Canada)
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under mandatory law that cannot lawfully be excluded, including:
- United Kingdom: your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013;
- Australia: the consumer guarantees under the Australian Consumer Law, which cannot be excluded — for a major failure you are entitled to a refund or replacement, and to compensation for other reasonably foreseeable loss;
- Canada: your rights under applicable provincial/territorial consumer-protection legislation.
Where these Terms conflict with such mandatory rights, those rights prevail.
18. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, extreme weather, pandemics or public-health measures, war or armed conflict, civil unrest, strikes, carrier or supplier failures, border or port closures, and government actions.

Our collection and use of personal information is described in our Privacy Policy.
20. Changes to These Terms
We may update these Terms at any time. Changes take effect when posted, with an updated "Last updated" date. The version in effect when you place an order applies to that order. Your continued use of the Services after changes take effect constitutes acceptance.
21. Termination
We may suspend or terminate your access to the Services at any time, without notice, if we reasonably believe you have breached these Terms or for any other lawful reason. Provisions that by their nature should survive termination will survive.
22. Governing Law
These Terms, and any dispute arising from them or from your use of the Services or purchase of products, are governed by the laws of Hungary, without regard to conflict-of-law rules, and without depriving you of the mandatory consumer protections of your country of residence (the United Kingdom, Australia, or Canada). Before starting any formal proceedings, please contact us at support@trystilla.us so we can try to resolve the matter.
23. General
- Severability: if any provision is found unenforceable, the remaining provisions remain in effect.
- Entire agreement: these Terms, with the policies incorporated by reference, are the entire agreement between you and us regarding the Services.
- No waiver: our failure to enforce any provision is not a waiver of it.
- Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
